Terms of Use
1. These terms, and what they cover
These terms govern your use of 110analytics.io, go.110analytics.io and any other website or publicly accessible dashboard we operate (together, “our websites”). By using them you accept these terms. If you do not accept them, please do not use our websites.
These are website terms only. They are not the terms on which we deliver services. Any engagement is governed by a separate written agreement, and nothing on our websites forms part of it.

2. Changes
We may change these terms, and we may change, suspend or withdraw any part of our websites, at any time. The version and date above show the current terms. Continuing to use our websites after a change means you accept the revised terms.
3. The content on our websites
3.1 Illustrative material
Some material on our websites, dashboards, charts, screens, figures and worked examples, is illustrative. It is there to show what our work looks like, not to report any client’s actual results. Where material is illustrative it is labelled as such on the page.
We do not publish invented performance figures. Any figure presented as real is real, and we will say where it comes from.
3.2 “Experience across leading organisations”
Where our websites or materials refer to experience across named organisations, this describes the professional career history of members of our team at those organisations. It does not mean that those organisations are clients of 110 Analytics Ltd, that they endorse us, or that they are in any way associated with us. Any names or marks used in that context are used descriptively to identify the organisation, and remain the property of their owners.
3.3 The Malta Media Battle dashboard
The Malta Media Battle dashboard analyses publicly available engagement data from the public social media pages of Maltese media organisations. It is published as commentary and as a demonstration of our analytical approach.
The figures are derived from public data using our own methodology, and are presented as measurements of public engagement, not as an assessment of any organisation’s editorial quality, commercial performance or standing.
Any commentary or interpretation is our opinion, offered in good faith on the data available.
Names and marks of the organisations analysed are used nominatively, to identify who is being measured. No affiliation, sponsorship or endorsement is claimed or implied.
If you represent an organisation featured and believe something is inaccurate, email admin@110analytics.io. We will review it, correct anything we get wrong, and remove your organisation on reasonable request.
3.4 No professional advice
Our websites are for general information. Nothing on them is legal, financial, accounting, tax or other professional advice, and nothing on them should be relied on as a basis for a decision. Take your own advice on your own circumstances.
3.5 Accuracy
We take care over our content but we do not warrant that our websites, or anything on them, are accurate, complete or up to date. Content may be changed or removed without notice.
4. Booking a call
Our websites invite you to book a call with us. That call is free of charge and carries no obligation on either side. Booking one does not create a contract for services and does not commit us to accepting an engagement, we may decline, reschedule or cancel, and we may end a call early where it is clear we are not the right fit.
When you book, you agree to give accurate details and to let us know if you cannot attend. What we do with the data you submit is set out in our Privacy Policy.
5. Acceptable use
You may use our websites for your own lawful, personal or internal business purposes. You must not:
use them in breach of any applicable law, or for any fraudulent or harmful purpose;
attempt to gain unauthorised access to any part of them, or to any system or network connected to them;
introduce any virus, malware or other harmful code;
scrape, crawl, harvest or systematically extract content or data from them, or use any automated means to access them, except a search engine’s ordinary indexing;
reverse engineer, copy or reproduce any dashboard, tool or interface we publish;
interfere with their operation, or with anyone else’s use of them, including by any denial-of-service or excessive-load activity; or
use them to send unsolicited commercial communications.
We may restrict or withdraw your access if you breach this section, and we will report anything that appears to be a criminal offence to the relevant authorities.
6. Intellectual property
All intellectual property rights in our websites and their content, text, graphics, layout, design, code, dashboards, methodologies, and the 110 Analytics name and logo, belong to us or to our licensors. Nothing in these terms transfers any of those rights to you.
You may view our websites, and print or download extracts, for your own reference or internal business use, provided you do not alter them and you keep any notices of authorship intact. You may quote or cite our published material with attribution to 110 Analytics Ltd and, where possible, a link to the source page. Any other use republication, redistribution, commercial use, or use of our content to build or train a competing product or dataset, requires our written permission.
Third-party names and marks appearing on our websites remain the property of their owners and are used as described in sections 3.2 and 3.3.
7. Links
Where we link to a third-party site, we do so for information. We do not control those sites, we do not endorse them, and we are not responsible for their content, their availability or their handling of your data.
You may link to our home page fairly and lawfully, in a way that does not damage our reputation or suggest an association or endorsement that does not exist. You must not frame our websites on another site or present our content as your own. We may withdraw permission to link at any time.
8. Availability
We do not guarantee that our websites will be available uninterrupted or error-free. We may suspend, withdraw or restrict all or part of them for business or operational reasons, including maintenance, and we will give notice where it is reasonable to do so. You are responsible for your own arrangements for accessing them, including your own device and connection security.
9. Our liability
Nothing in these terms limits or excludes our liability where it cannot lawfully be limited or excluded. In particular, nothing here affects our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any liability that under Maltese law cannot be excluded, including, where you deal with us as a consumer, your rights under the Consumer Affairs Act (Chapter 378 of the Laws of Malta) and applicable EU consumer protection law. Those rights are not affected by these terms.
Subject to that:
We provide our websites and their content “as is”, and we exclude all warranties, conditions and representations not expressly set out here, to the fullest extent the law allows.
We are not liable for any loss arising from your reliance on our websites’ content, including any decision you take on the basis of it.
Where you use our websites in the course of a business, we are not liable for loss of profit, loss of revenue, loss of business, loss of anticipated savings, loss of or corruption of data, or any indirect or consequential loss, however arising.
Where liability is not otherwise excluded, our total liability in connection with your use of our websites is limited to EUR 500.
We are not liable for any loss caused by a virus or other harmful material you may encounter through our websites, or by a failure of the internet or of any third-party service.
10. Privacy and cookies
How we handle personal data is set out in our Privacy Policy. Our use of cookies, and how to change your choices, is set out in the same document and can be revisited at any time using the Cookie settings link in our footer.
11. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or your use of our websites, are governed by the laws of Malta, and the courts of Malta have exclusive jurisdiction.
If you use our websites as a consumer resident in another EU member state, this does not deprive you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings in the courts of that country where EU law gives you that right.
12. General
If any provision of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce any provision is not a waiver of it. These terms are between you and us; no one else may enforce them. Together with our Privacy Policy they are the whole of the agreement between us regarding your use of our websites.
